2. Description of Service
This Service provides maintenance tracking, inventory management, and operational tools for property management and maintenance teams.
3. Ownership of Software
The software, including all code, design, and functionality, remains the sole property of Eric Sessums / Maintainly. Use of the Service does not grant ownership or rights to the underlying software.
4. License to Use
Users are granted a limited, non-exclusive, non-transferable license to use the Service for internal business operations.
Users may NOT:
- Copy, distribute, or resell the software
- Reverse engineer or attempt to extract source code
- Use the software outside of agreed business purposes
5. User Responsibilities
You agree to:
- Provide accurate information
- Use the system lawfully
- Not misuse or disrupt the Service
6. Data Responsibility
Each organization is responsible for the accuracy and legality of the data they enter into the system.
7. Support Access and Impersonation
To provide support, troubleshooting, and account recovery, authorized Maintainly personnel may access customer workspaces, including by using administrative impersonation tools.
Support access is limited to legitimate operational purposes, is restricted to authorized personnel, and may be logged for security and audit purposes.
By using the Service, you authorize this support-access model as described in these Terms and the Privacy Policy.
8. Service Availability
The Service is provided "as is" and may be updated, modified, or temporarily unavailable without notice.
9. Limitation of Liability
The developer is not liable for:
- Data loss
- Business interruption
- Indirect or consequential damages
Use of the Service is at your own risk.
10. Termination
Access may be suspended or terminated at any time if terms are violated.
11. SMS Communications & Consent
By submitting a booking or inquiry form that includes your phone number, you consent to receive SMS messages from Maintainly, including a booking confirmation text and appointment reminder messages related to your scheduled demo or sales call.
Message frequency varies. Standard message and data rates may apply. You may opt out at any time by replying STOP to any message. Reply HELP for assistance. Opting out will not affect your scheduled appointment.
12. Changes to Terms
These Terms may be updated at any time. Continued use of the Service constitutes acceptance of updated Terms.
